Contest:
Artists enter songs and listeners vote for their favorites. The staff of the 2008 After the Jump Festival ("Festival") will determine the winner from the 3 artists receiving the most listener votes. The winner has the opportunity to perform on the main stage at the Festival in Brooklyn, New York on June 21, 2008, and receive other prizes. A listener selected in a random drawing by the Sponsor will receive an autographed copy of the winning artist's CD, among other prizes. All federal, state and local laws and regulations apply. Void where prohibited, taxed or regulated.
Eligibility:
The After the Jump Fest Contest ("Contest") is open to residents of the 50 United States (including the District of Columbia) who are registered members of Sponsor or are vocalists or musicians or members of a musical group ("Artists") of legal age registered with Sponsor.
The following are NOT eligible to enter the Contest:
- Owners, employees or agents of vendors providing products and/or services for or in connection with the Contest, including prizes; and
- Members, managers, employees or agents of Sponsor or any of its affiliates.
Sponsor reserves the right to verify eligibility qualifications and to disqualify any registrant found to be in violation of the Official Rules.
How to Enter:
Artists: To submit songs or compositions ("Songs"), go to the "upload" area of your profile on the Sponsor's website and mark not more than three (3) of your uploaded Songs as "eligible" for the Contest. You may mark as "eligible" both currently uploaded and newly uploaded Songs. Songs with lyrics which are obscene, profane or not in good taste in the sole discretion of Sponsor will not be eligible to win. By marking a song as "eligible" for the Contest, Artists are attesting that they are the rightful owners of the Song and that the Song does not infringe on any third party's copyrighted material, trademark or other intellectual property and may be performed and broadcast without obtaining permission from or making any payment to any third party, and agree to provide the Sponsor with an autographed CD at no cost to the Sponsor.
Artists must submit their Songs by 11:59 p.m., Florida time, on June 3, 2008.
Listeners: To vote for a Song, go to the Sponsor's website, click on "After the Jump Fest" Contest and listen to the submitted Songs, then vote - thumbs up for or thumbs down against the Song. Listeners can vote once each day for any one or more Songs from 12:01 a.m., Florida time, on June 4, 2008 through 11:59 p.m., Florida time, on June 10, 2008 ("Voting Period").
General: Sponsor will not verify receipt of submissions. Automated or mechanically reproduced submissions are prohibited and, if used, will be disqualified. Sponsor is not responsible for lost, late, illegible, misdirected submissions or transmissions or problems of any kind, whether mechanical, human or electronic. Submissions are the property of Sponsor and will not be acknowledged or returned.
By participating, each Artist and Voter (i) agrees to be bound by these Official Rules, (ii) consents to Sponsor's use of his/her/their name for promotional purposes in any media, without additional compensation unless prohibited by law, and (iii) agrees that, if selected a winner, will be solely responsible for any and all tax liabilities or consequences of accepting and receiving a prize.
Prize Details:
Artist's Prize: The opportunity to perform on the main stage at the 2008 Jump the Festival on June 21, 2008 in Brooklyn, New York and, if taken, one track in the After the Jump Festival compilation CD, plus $2,000 cash (Approximate Retail Value: $2,000)
Voter's Prize: An autographed copy of the winning Artist's CD, the 2008 After the Jump Festival compilation CD, and a 2008 After the Jump Festival T-Shirt (Approximate Retail Value: $60)
Total approximate retail value of all prizes: $2,060
Awarding of Prizes:
Voter: The wining Voter will be determined in a random drawing by the Sponsor on June 13, 2008 from those eligible. Odds of winning depend on number of eligible entries received. Sponsor's decisions are final.
Artist: The three (3) Artists receiving the most votes during the Voting Period will be submitted to the staff of the After the Jump Festival who will select the winner, on or about June 13, 2008, based upon the originality of the music, quality of songwriting and lyrics, and listenability.
General: No substitution, cash alternative or transfer of prize is permitted. Sponsor reserves right to substitute a prize with a prize of equal or greater value. If winner is a minor, prize will be awarded in the name of the parent or legal guardian.
The potential winning Artist and Voter will be notified on or about June 13, 2008 by e-mail to their "Stereofame" profile, and will be sent an Affidavit of Eligibility and Liability/Publicity Release. Potential winners must complete the Eligibility Affidavit and return it, and the signed Liability/Publicity Release, to Sponsor within ten (10) business days or an alternate will be selected. If potential winner cannot be contacted within three (3) calendar days (during normal working hours) from first attempt, an alternate winner will be selected.
Sponsor's Rights:
Sponsor reserves the right, in its sole discretion and without responsibility or liability to: (i) make all decisions concerning eligibility, which decisions shall be final and binding; (ii) disqualify anyone whom Sponsor determines has been responsible for any tampering with the promotion process or is ineligible or otherwise in violation of the Official Rules; and (iii) suspend, cancel or modify the promotion at any time in the event of any circumstances which may prevent the promotion from proceeding as planned or which may adversely affect the administration, security, fairness or integrity of the promotion, including without limitation the process by which a winner is selected.
Limitation of Liability:
By participating in the promotion, Voters and Artists ("Participants") agree that Sponsor, its affiliates, or their respective members, managers, shareholders, directors, officers, employees, agents and other authorized representatives are not responsible or liable for: (i) misaddressed, lost, late, ineligible, incomplete or illegible promotion documents; (ii) any injuries, losses, damages, taxes or expenses of any kind incurred as a result of Participants' participating in the promotion or Participants' winning, accepting, taking possession of, or in any manner using or misusing a prize; (iii) any printing or typographical error in any materials associated with the promotion, or human or technical error, which may occur in processing entries submitted in connection therewith; or (iv) any theft or destruction of, or unauthorized access to, or use or alteration of, any of the Participants' Information submitted hereunder. By participating in the contest, Participants agree to fully and forever release and hold harmless Sponsor, its affiliates, and their respective members, managers, shareholders, directors, officers, employees, agents and other authorized representatives, from any and all losses, damages, rights, claims, actions, or expenses (including attorneys' fees and costs) of any kind whatsoever, in connection with the Promotion or resulting from Participants' participation therein, and, if a winner, any personal injury, death, and/or property damage.
Any and all disputes, claims and causes of action arising out of or connected with this promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion, but in no event attorney's fees. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this promotion should virus, bugs, non-authorized human intervention or other causes beyond the control of sponsor corrupt or impair the administration, security, fairness or proper play of the promotion. In such event, Sponsor may award prizes in a random drawing from all eligible entries received up to the date of cancellation or suspension. Sponsor is not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions. Sponsor may prohibit any of the Participants from participating in the promotion or winning a prize if, in its sole discretion, it determines that such Participant is attempting to undermine the legitimate operation of the promotion by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
Winners' List:
The names of the winning Artist and Voter may be obtained by sending a self-addressed stamped envelope, after June 15, 2008, to "After the Jump Fest Contest", c/o Stereofame, Inc., P.O. Box 3359, Ponte Vedra Beach, Florida 32004-3359. Winners' names will also be posted online at www.stereofame.com. on or about June 30, 2008.
